Rental Agreement Terms and Conditions

Article 1

During the rental period, the renter is responsible for all costs related to the use of the bicycle(s) and/or other rented items, such as storage and tire repairs.

Any transportation costs for the bicycle(s) and/or other rented items are the responsibility of the renter.

Article 2
Repairs to the bicycle(s) and/or other rented items without the landlord’s permission are at the renter’s expense.

Article 3
The
renter is liable for damage caused by the loss of accompanying documents, such as insurance certificates or any cross-border documentation.

Article 4
The
renter acknowledges that no additional insurance policies have been taken out for the bicycle(s) and/or other rented items. Any insurance desired by the renter must be arranged and paid for by the renter. Theft is therefore at the renter’s own risk.

Article 5

The renter is liable for all damage caused to the bicycle(s) and/or other rented items and accessories, as well as any consequential damage, whether or not the renter is at fault, and regardless of whether this occurred due to force majeure.

The renter indemnifies the landlord against all claims from passengers, users, or third parties for damages for which the landlord might be held liable by law but is not covered by the landlord’s liability insurance.

The renter indemnifies the landlord against all fines, penalties, administrative sanctions, etc., imposed on the landlord as a result of crimes or violations committed by the renter and/or driver and/or passengers during the rental period. For such fines, penalties, and administrative sanctions, the renter assumes full risk and responsibility in relation to the landlord and, where possible, externally.

Clauses 2 and 3 do not apply if the renter proves that the amounts owed by the landlord resulted from a defect in the bicycle(s) that existed at the start of the rental period.

Article 6
In
the event of damage, loss, or theft—whether or not caused by the renter or driver of the bicycle(s)—concerning the bicycle(s), any accompanying document(s), or other items, or damage caused to third parties, the renter must immediately inform the landlord by phone and confirm this in writing. The renter must follow the landlord’s instructions and, if possible, have the incident officially documented by the police. Failure to provide notification or follow instructions will make the renter liable for any resulting damages suffered by the landlord.

Article 7
The landlord is
not liable for any costs and/or damages incurred by the renter, the driver of the bicycle(s), or passengers resulting from damage, defects, loss, or theft of the bicycle(s) and accessories, or damage caused to third parties.

Article 8
If the bicycle(s) and/or other rented items are rented on a daily basis, a new daily rental fee will be charged if they are not returned to the landlord by closing time (6:00 PM/8:00 PM). If the bicycle(s) and/or other rented items are used for longer than agreed, the rental will automatically continue under the same terms until the maximum agreed extension period is exceeded.

Article 9
When returning the bicycle(s) and/or other rented items in the same condition as at the start of the rental period, the deposit will be refunded to the renter. If the deposit was paid in cash, it will be refunded immediately in cash. If paid via bank transfer, the deposit will be refunded to the renter’s account within three business days.

Article 10
The landlord reserves
the right to terminate the rental agreement at any time without judicial intervention if, in their opinion, the renter is not using the bicycle(s) responsibly.

Note:
In case of a breakdown,
you can always contact us. On the island of Walcheren, we can usually arrange to pick you up or provide a replacement bicycle. Outside of Walcheren, this service is not available.
